HIPAA NOTICE OF PRIVACY PRACTICES

This Notice of Privacy Practices (“Notice”) describes how New Day Recovery Services LLC (“New Day,” “we,” “us,” or “our”) may use and disclose your protected health information (“PHI”) and your rights regarding your PHI.

Our Legal Duty

We are required by law to:

  • Maintain the privacy of your PHI
  • Provide you with this Notice of our legal duties and privacy practices
  • Follow the terms of the Notice currently in effect
  • Notify you if we are unable to agree to a requested restriction
  • Notify you following a breach of unsecured PHI

Treatment: We may use and disclose your PHI to provide, coordinate, or manage your healthcare and related services. This includes consultation with other healthcare providers involved in your care.

Special Protections for Substance Use Disorder Records (42 CFR Part 2)

Federal law (42 CFR Part 2) provides special privacy protections for substance use disorder treatment records. New Day Recovery Services is a federally assisted substance use disorder treatment program, and your records related to substance use disorder diagnosis, treatment, or referral are protected under 42 CFR Part 2.

These records may not be used or disclosed in any civil, criminal, administrative, or legislative proceeding against you unless:

  • You provide specific written consent, or
  • A court issues a qualifying order permitting disclosure

Penalties for violations of 42 CFR Part 2 align with HIPAA civil and criminal enforcement provisions. Unauthorized disclosure of substance use disorder records is prohibited and subject to significant penalties.

Your written consent is required before we can disclose substance use disorder treatment records for purposes beyond treatment, payment, healthcare operations, or as otherwise permitted by law.

Uses and Disclosures That Require Your Written Authorization

We will obtain your written authorization before using or disclosing your PHI for purposes not described in this Notice, including:

  • Most uses and disclosures of psychotherapy notes
  • Marketing purposes (if applicable)
  • Sale of PHI (we do not sell PHI)

You may revoke your authorization in writing at any time, except to the extent we have already taken action in reliance on it.

Your Rights Regarding Your PHI

You have the following rights with respect to your PHI:

Right to Request Restrictions: You may request restrictions on certain uses and disclosures of your PHI. We are not required to agree to your request except in limited circumstances.

Right to Receive Confidential Communications: You may request that we communicate with you about your PHI by alternative means or at alternative locations.

Telehealth Services

New Day Recovery Services offers online Intensive Outpatient Program (IOP) services via secure, HIPAA-compliant telehealth technology.

Technology and Privacy: We use encrypted, HIPAA-compliant video conferencing platforms to protect the confidentiality of your PHI during telehealth sessions. However, no electronic transmission is entirely risk-free. By participating in telehealth services, you acknowledge and accept the potential risks associated with electronic communication, including:

  • Interruptions or technical difficulties
  • Unauthorized access despite reasonable safeguards
  • Limitations in the quality of the audio or video connection

Informed Consent: Your participation in telehealth services constitutes your informed consent to receive treatment via remote communication technology. You may withdraw your consent and discontinue telehealth services at any time.

Limitations: Telehealth services are provided in accordance with applicable Texas state licensing requirements. Services may not be available to individuals located outside of Texas at the time of the session.

Recording Policy: Telehealth sessions are not recorded by New Day Recovery Services unless you provide specific written consent for recording purposes.

Telehealth Services – Additional Terms

In addition to the general Terms of Use, the following terms apply specifically to our online Intensive Outpatient Program (IOP) telehealth services:

Informed Consent for Telehealth: By participating in our online IOP services, you acknowledge and agree that:

  • Telehealth services involve the use of electronic communications to provide treatment remotely
  • The same standards of confidentiality and professional conduct apply to telehealth services as apply to in-person services
  • Despite reasonable security measures, there are inherent risks in electronic communication, including potential interruptions, technical failures, and unauthorized access

Technology Requirements: You are responsible for ensuring you have access to a reliable internet connection and compatible device (computer, tablet, or smartphone) to participate in telehealth sessions.

Location: You must be physically located in the State of Texas at the time of each telehealth session. Services cannot be provided to individuals located outside of Texas due to licensing restrictions.

Technical Support: Technical support is available to assist with platform access and troubleshooting. Contact our admissions team at (210) 390-1187 for assistance.

Emergency Situations: Telehealth services are not appropriate for emergency situations. If you are experiencing a mental health or substance use emergency, call 911 or go to your nearest emergency room immediately.

Right to Discontinue: You may discontinue telehealth services at any time and request to transition to in-person services if available and clinically appropriate.

Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site following any changes constitutes acceptance of the revised Terms.
